1. Introduction
By accessing and using the website https://www.iienstitu.com (hereinafter referred to as the "Site"), operated by ENSTITU OÜ (Tartu mnt 67/1-13B, 10115 Tallinn, Estonia), and by completing a purchase for educational or other digital services, the user (“User”) agrees to the terms and conditions set forth in this Membership Agreement.
2. Parties
Company ("Institution"): ENSTITU OÜ, the operator of the Site.
User: An individual who becomes a member of the Site by completing the registration process.
This Agreement outlines the rights and obligations of both parties related to the use of the Site and its services. By accepting this Agreement, the User declares that they are legally competent and over the age of 18.
3. Responsibilities
The Institution reserves the right to update pricing and modify services at any time.
The Institution commits to ensuring uninterrupted access to the purchased services, except in cases of technical failure.
The User agrees not to attempt reverse engineering, extract source code, or carry out any activity intended to manipulate the Site’s functionality.
The User agrees not to share or publish unlawful, offensive, misleading, obscene, defamatory, pornographic, copyright-infringing, or harmful content; nor disrupt lessons, spam other users, or interfere with platform operations.
Violations may result in suspension or termination of the account without notice, and legal action may be pursued if necessary.
The Institution disclaims any liability for interactions between Users or between Users and third parties.
4. Intellectual Property Rights
All titles, trade names, trademarks, patents, logos, designs, methods, and other intellectual property displayed on the Site are the exclusive property of the Institution or its licensors.
No part of the Site may be copied, distributed, published, or used on other platforms without prior written consent.
5. Privacy and Data Protection
Personal data provided by the User is protected under the EU General Data Protection Regulation (GDPR). This includes any personally identifiable information such as name, address, phone number, and email.
The Institution does not disclose personal data to third parties for commercial or advertising purposes without consent.
With the User’s consent, personal data may be used for marketing, promotion, and campaign communication, and for statistical and customer profiling purposes.
The Institution may share data with official authorities only if legally required to do so.
6. Registration and Security
The User is responsible for providing accurate and up-to-date registration information.
The User is solely responsible for safeguarding their login credentials. The Institution is not liable for losses resulting from account misuse.
7. Force Majeure
In cases of force majeure—natural disasters, wars, civil unrest, epidemics, infrastructure failures, etc.—the parties are not liable for the non-performance of their contractual obligations. In such cases, obligations will be suspended until the force majeure ends.
8. Severability
If any provision of this Agreement becomes invalid or unenforceable, the remaining provisions shall remain in full force and effect.
9. Amendments
The Institution reserves the right to amend this Agreement or modify services offered through the Site. Changes become effective upon publication. Continued use of the Site constitutes acceptance of the updated terms.
10. Notices
Official notices between parties shall be made via the registered email addresses. Users must update their contact information within 5 days of any change. Notices sent to the registered address will be considered valid.
11. Evidence Agreement
In case of any legal dispute, electronic records, logs, and communication data maintained by the Institution will be considered valid and binding evidence under applicable laws.
12. Dispute Resolution
Any disputes arising from the interpretation or execution of this Agreement shall be resolved before the courts and enforcement offices of the Tallinn jurisdiction, unless otherwise required by mandatory consumer law.
